Illustrations and Premium Rates
You might not be eligible for some life insurance premium rates. Premium rates are being disclosed only for general information purposes and are subject to pricing and other requirements from UV Insurance. For more details on the plan corresponding to your personal needs, UV Insurance recommends that you contact an authorized sales representative.
Online Insurance Application
The website allows you to make an online insurance application for specific products. To make sure that you take advantage of the coverage you have selected, you must disclose all the facts known to you which are likely to influence the setting of your premium rate, the appraisal of the risk or the decision to insure you. You must ensure that any information you provide us is accurate and up to date, failing which we reserve the right not to follow up on an insurance request.
An application submission is available only to users who are legally entitled to enter into contracts, as provided for by applicable laws. By using our services, you represent and warrant to us that you have reached the legal age in your place of residence to enter into a contract or that you have obtained the prior consent of a parental authority to use them.
Any insurance request made on the website must be completed personally. Our response to your request is based on information that you submit and on some assumptions when applicable. An insurance application is neither an acceptance of insurance nor a guarantee of insurability and does not constitute enrolment of insurance and is conditional upon your qualification under our underwriting standards. If applicable, your insurance contract will be sent to you, based on your preferences, by mail or in electronic format.
By using the online services, you acknowledge that the use of your email address and password, if applicable, constitutes your signature. You also acknowledge that checking a box or clicking on key words such as “OK,” “Send” and “Accept” or any other similar wording constitutes your acceptance and is legally binding on you. By doing so, you confirm that you have carefully read and understood the terms, conditions and procedures relating to the application or purchase of your insurance contract and acknowledge that this action constitutes proof of your agreement to be bound by them.
Before submitting an insurance application using the website, you must first review a confirmation window (the “policy summary”) which displays, along with other information, your personal details, the amount of insurance, the effective date of the policy, the termination date of the policy, the monthly premium, the renewal conditions, the risks covered, the beneficiaries of the policy and a sample contract. Subject to any provision to the contrary contained in the Consumer Protection Act applicable in Quebec, when you transmit your insurance application (by clicking on the Submit button), the application thus transmitted constitutes an offer by you to UV Insurance to purchase the insurance product described on the confirmation page (the “policy summary”), subject to the terms and conditions presented.
Use of the Portal
Your use of the portal is also subject to the conditions set out herein. The provisions of the Privacy Policy apply to the personal information available on UV Insurance’s portal and website.
When you purchase one of our products, a user account (the “portal”) is automatically created. When creating your portal, you agree to provide
UV Insurance with true and complete information as required by the questionnaire, and to update this information as necessary to keep it accurate at all times.
You are solely responsible for maintaining the confidentiality of your portal and any activity that occurs under your account.
If UV Insurance concludes that you have violated these Terms and conditions, UV Insurance reserves the right to suspend or terminate access to your account without prior notice.
UV Insurance cannot guarantee that unauthorized third parties will not defeat security measures or make wrongful use of any information you provide to UV Insurance through the website. You acknowledge that you provide your Personal Information at your own risk.
You may not use another person’s account, unless you have the account holder’s permission as their authorized agent.
Terms of Payment
Terms of payment are determined at the sole discretion of UV Insurance. Payment will be made by credit card unless another method of payment has been accepted by UV Insurance. All credit card payments are submitted to the approval of the financial institution that issued the credit card.
By clicking on “Authorize payment,” you confirm that you are the rightful owner of the credit card.
UV Insurance uses a third-party supplier, Clover, to process your payment. Payment processing will be subject to Clover’s Terms or conditions and Privacy Policy. In other words, to use our services, you must agree to be bound by the Terms and conditions of these Third Parties.
Security
To protect your personal information, all precautions are taken to ensure compliance with relevant legal requirements, including the Act respecting the protection of personal information in the private sector (Quebec), as amended by Bill 25, the Privacy Act (Canada), as well as recognized privacy practices.
Thus, should you provide us with your credit card information, such information is encrypted using the technology offered by the Clover system.
Validation of Contract
Immediately prior to the conclusion of the contract, a summary of the information obtained as well as the options and Terms and conditions chosen for the insurance product you are about to purchase will be made available to you.
To access the purpose of the contract, follow the online procedure and click on “____.” You will then receive confirmation of the conclusion of the contract, the applicable rules, the right of rescission and the Terms and conditions, as well as the way in which your policy will be provided.
Changes
UV Insurance reserves the right to change the Terms and Conditions of the portal and website at any time and without prior notice. You are fully responsible for all activities completed through your account associated with the portal and website. You must not disclose your login information to anyone or allow anyone to use your account. You must not connect to the portal or to the website by using someone else’s email address and password, and you agree that such a use would be a violation of the conditions of use.
Despite the security measures in place, you must remain vigilant when using the Internet. You must ensure that your login information used to access any part of the website is protected at all times.
You must notify UV Insurance immediately if you discover or suspect any unauthorized use of your login information to access the portal and the website or any other breach of security involving the portal or website.
Limitation of Liability
You acknowledge and agree that you assume all risk arising from your access to or use of the portals and the website. To the fullest extent permitted by applicable law, UV Insurance, its affiliates, directors, employees, agents, successors and assigns, shall not, under any circumstances, be held liable for damage of any type whatsoever, including but not limited to loss of use, loss of profits or loss of data, whether in contract, tort or otherwise, arising directly or indirectly, from the use or operation of the website and portals, including any damage caused by or resulting from a user’s reliance on any information obtained through the website and portals, or resulting from any error, omission, interruption, deletion of files or emails, malfunctions, viruses, delay in operation or transmission or any failure of performance.
UV Insurance is committed to doing everything in its power to ensure the best possible access to UV Insurance portals. Overall, you accept and acknowledge that your use of the UV Insurance portals, including the information you provide, is under your sole and entire responsibility. UV Insurance cannot be held responsible and will not be liable to provide compensation for any direct or indirect loss resulting from the unavailability of the portals. In no event will UV Insurance be held responsible for any damage resulting from the loss, alteration or fraudulent use of data, the accidental transmission of viruses or other harmful contents, or from the attitude or behaviour of a third party. UV Insurance will not be held liable for (i) the unavailability of the website and portals (ii) misuse of the website and portals (iii) overload of the Internet (iv) malfunctions on mobile devices used by you, (v) force majeure or any other event beyond its control.
Absence of Warranty
The services made available through the website and portals are provided to you “as is,” without warranties of any kind. To the fullest extent permitted under applicable law, UV Insurance disclaims all warranties, whether express or implied, including warranties as to non-infringement, accuracy of content and freedom from error. UV Insurance may update its website and portals without prior notice to users. Although UV Insurance strives to ensure that the information presented on its website and portals is complete and accurate, UV Insurance does not guarantee that such information is free of errors, omissions and inaccuracies.
UV Insurance does not guarantee the absence of bugs, inaccuracies, errors, or other harmful elements. The UV Insurance website and portals depend on the mobile and Internet network to function. UV Insurance declines all responsibility in case of unavailability of the network or problems linked to operating systems. No right to compensation is granted under this paragraph. UV Insurance reserves the right to cease, without notice, without compensation and at its sole discretion, permanently or temporarily, to provide all or part of the functionalities of its website and portals.
Compensation
By using our website and portals, you agree to defend, indemnify, and hold harmless UV Insurance, its affiliates and affiliates, and their respective officers, agents, directors, employees, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) and amounts paid in settlement arising out of or related to your use of the website and portals, or your violation of the Terms and conditions or the rights of third parties. UV Insurance shall have the exclusive defence and control of any matter for which you have committed to indemnify UV Insurance and you agree to assist and cooperate with UV Insurance in the defence or settlement of any such matter.
